WAIVER AND LIABILITY RELEASE AGREEMENT

WATERFRONT & POND ACCESS

The property provides private access to White Island Pond via an exterior staircase of approximately 20 steps. Guest acknowledges and agrees to the following:

[ - ] The staircase and pond access area may be wet, slippery, or uneven. Guest agrees to use caution at all times.

[ - ] Guest assumes full responsibility for any injury, accident, or incident occurring on or near the staircase, dock area, or pond shoreline.

[ - ] Children must be supervised by an adult at all times near the pond and staircase.

[ - ] Guest acknowledges that swimming in White Island Pond is at their own risk. No lifeguard is on duty.

[ - ] Guest agrees not to access the pond or staircase while under the influence of alcohol or controlled substances.

[ - ] Host is not responsible for water conditions, depth, or natural hazards in or around White Island Pond.

KAYAK USE & WATER ACTIVITIES

Kayaks are provided complimentary for Guest use. By using the kayaks, Guest agrees:

[ - ] Guest uses all kayaks and watercraft entirely at their own risk.

[ - ] Life jackets / personal flotation devices (PFDs) must be worn by all kayakers.

[ - ] Children under 18 must wear a PFD at all times while on or near the water and must be accompanied by a responsible adult.

[ - ] Guest agrees not to operate kayaks after dark or during severe weather conditions.

[ - ] Guest is responsible for any damage to kayaks or equipment caused by misuse or negligence.

[ - ] Host assumes no liability for injury, drowning, or accident arising from kayak use or any water activity.

[ - ] Guest represents that they have sufficient swimming ability and physical fitness for water activities undertaken.
